Research updates and corrections

New records and what they change. When a material statement changes, the update says what it said before and why. Conclusions are never rewritten silently.

Initial review of Town records, the 1998 permit and the HOA's amendment materials

The first set of records has been inventoried and read. They are the recorded 1998 Special Use Permit, three batches of Town of Indian Trail email released under a public information request, the Town Manager's February 2025 email on open space, and the HOA's letter and FAQ posted at crismarkhoa.com.

New information. The Town's records describe the land's zoning history. They give the Town's position that a 2018 rezoning to Multi-Family Residential replaced the 1998 permit's conditions, and they record a Planning Director's statements in 2026 that the land is "still tied" to the Crismark CC&Rs.

Not yet obtained. The recorded Crismark Declaration, the proposed amendment, the Consent form, the Complaint, and the 2018 zoning action itself. Most claims are therefore marked Requires additional information rather than assessed.
